DCS Lawsuit Filed in Texas

On behalf of our clients, Lemberg & Associates recently filed a complaint in U.S. District Court, Southern District of Texas, against Diversified Collection Services. Our client alleges that Diversified Collection Services called her cell phone up to four times a day, and threatened to garnish her wages if she didn’t pay the debt. Diversified Collection Services also threatened to take money out of her bank account and garnish her tax return. In order to avoid this, our client entered into a payment agreement with Diversified Collection Services to make six monthly payments. When she called Diversified Collection Services to make a payment, Diversified Collection Services told her she had to make three additional payments.

The lawsuit charges that Diversified Collection Services violated the Fair Debt Collection Practices Act (FDCPA) by engaging in harassing behavior; by employing false and deceptive means to collect a debt; by threatening garnishment; and by employing false and deceptive means to collect a debt. In addition, the lawsuit charges that Diversified Collection Services violated the Texas Debt Collection Act and invaded our client’s privacy.

On behalf of our client, Lemberg & Associates recently filed a complaint in U.S. District Court, District of Nebraska, against Diversified Collection Services. Our client alleges that Diversified Collection Services called her workplace, and that she told Diversified Collection Services that her employer didn’t permit personal calls and asked that they not call her at work. Nevertheless, Diversified Collection Services called her at work again.

The lawsuit charges that Diversified Collection Services violated the Fair Debt Collection Practices Act (FDCPA) by contacting our client at a place and time known to be inconvenient; by contacting her at her workplace, knowing that her employer prohibited such calls; by engaging in harassing behavior; and by using false, deceptive, or misleading representation or mean in connection with the collection of a debt.

On behalf of our client, Lemberg & Associates recently filed a complaint in U.S. District Court, Eastern District of Pennsylvania, against Diversified Collection Services. Our client alleges that Diversified Collection Services called multiple times a day and that the Diversified Collection Services debt collector used rude and abusive language. The debt collector allegedly yelled at our client and threatened to take legal action if the debt was not paid. When our client asked to speak to a supervisor, the debt collector hung up. Moreover, Diversified Collection Services did not send a 30-day validation notice to our client.

The lawsuit charges that Diversified Collection Services violated the Fair Debt Collection Practices Act (FDCPA) by engaging in harassing behavior; by using profane and abusive language; by using false, deceptive, or misleading representation in connection with the collection of a debt; by threatening to take legal action without actually intending to do so; and by failing to send a validation notice. The lawsuit also charges that Diversified Collection Services violated the Pennsylvania Fair Credit Extension Uniformity Act, violated the Pennsylvania Unfair Trade Practices and Consumer Protection Law, and invaded our client’s privacy.

On behalf of our client, Lemberg & Associates recently filed a complaint in U.S. District Court, Northern District of Georgia, against Diversified Collection Services. Our client alleges that Diversified Collection Services told her that she could enter into a loan rehabilitation program and that, once she made nine consecutive payments on time, she would no longer be considered in default status. Once this happened, DCS allegedly told her that negative marks on her credit report would be removed and that the IRS wouldn’t withhold her tax refund.

Our client made the agreed-upon nine payments, but Diversified Collection Services didn’t remove her account from default status or remove the negative credit report. In addition, the IRS withheld her income tax refund. She alleges that, when she complained to DCS, she was told they would not help her get her money back from the IRS.

The lawsuit charges that Diversified Collection Services violated the Fair Debt Collection Practices Act (FDCPA) by using false, deceptive, or misleading representation to collect a debt; and by communicating false credit information. In addition, the lawsuit charges that Diversified Collection Services violated the Georgia Fair Business Practices Act by engaging in unfair or deceptive acts to collect the debt.

DCS: From Our Case Files

On behalf of our client, Lemberg & Associates recently filed a complaint in U.S. District Court, Southern District of Mississippi, against Diversified Collection Services. Our client alleges Diversified Collection Services repeatedly called his home and cell phones, even after he asked numerous times that DCS not call his cell phone during work hours because he isn’t allowed to take personal calls at work. Further, our client alleges that DCS continued to contact him up to five times a day, even after he asked Diversified Collection Services to cease all communications with him.

The lawsuit charges that Diversified Collection Services violated the Fair Debt Collection Practices Act (FDCPA) by contacting our client at a time and place known to be inconvenient; by engaging in harassing behavior; and by failing to send a validation notice. In addition, the lawsuit charges that Diversified Collection Services invaded our client’s privacy and violated Mississippi state law by intentionally inflicting emotional distress.
