On behalf of our client, Lemberg & Associates recently filed a complaint in U.S. District Court, Western District of North Carolina, against Capital Recovery Collection Solutions. Our client alleges that, in attempting to collect a $350 debt, Capital Recovery Collection Solutions called our client’s workplace and revealed information about our client’s debt to attempted to collect a debt to his coworker. Capital Recovery Collection Solutions also told our client’s coworker that if our client didn’t pay that day, Capital Recovery Collection Solutions would serve our client with a summons for a lawsuit. In addition, Capital Recovery Collection Solutions called our client’s mother and told her that our client owed a debt.
The lawsuit charges that Capital Recovery Collection Solutions violated the Fair Debt Collection Practices Act (FDCPA) by contacting third parties for purposes other than to obtain location information; by revealing debt information to third parties; by engaging in harassing behavior; by using false, deceptive, or misleading representation in connection with the collection of a debt; by threatening to take legal action without intending to do so; and by employing false and deceptive means to collect a debt. The lawsuit also charges that Capital Recovery Collection Solutions violated the North Carolina Fair Debt Collection Practices Act and the North Carolina Debt Collection Act.
