Wakefield & Associates, which has offices located in Colorado and Oklahoma, bills itself as an accounts receivable debt management company, which means that they collect on past due accounts. They conduct collections for the healthcare industry, real estate firms, and financial service companies, as well as commercial and educational programs.

In the last three years, Wakefield & Associates has managed to rack up 26 complaints with the Better Business Bureau. Three of those complaints were for service shortfalls, while 23 of them were for questionable collection practices. Although Wakefield & Associates received an A+ rating for the length of time that it’s been in business and its willingness to address the complaints, it is not accredited with the BBB.

A simple Internet search reveals dozens of consumer complaints about the company’s tactics, including a report from one man who said that he had his wages garnished for a five-year-old debt. He said he hadn’t received any prior notice about the wage garnishment, the address was incorrect on the garnishment notice, and no one had tried to work it out with him before they filed a lien on his wages. In addition, other people reported being treated rudely, with derisive attitudes and snide remarks from the debt collectors about how they wouldn’t be in this position if they had paid their bills when they were due.

Stop Wakefield & Associates Harassment

A debt collection agency must comply with the rules and regulations of the Fair Debt Collection Practices Act (FDCPA). For instance, they cannot harass you or threaten to take any kind of action that they do not intend to carry out. This includes telling you that they will garnish your wages or negatively affect your credit report. They cannot call you to the point of harassment, discuss your debt with anyone else, call you at your place of employment after you have asked them not to, or use demeaning or abusive language in order to collect the debt.

If you have been contacted by a debt collector and feel that you have been harassed, you have some options to consider. You can contact the Federal Trade Commission or Consumer Financial Protection Bureau and file a complaint against them, or you can file a complaint with the Better Business Bureau. If the harassment doesn’t stop, you can contact an attorney who understands debt collection law and talk to them about filing a lawsuit in court against the collection agency. If you win, the debt collection agency may be required to pay your lawyer’s fees, court courts and up to $1,000 in damages to you.
