Keep copies of all letters that you send, as well as any communications that you receive from them. Any time you send them written communication, send it certified mail, return receipt requested. If your state allows you to record phone calls, record the conversation every time you talk to a debt collector. Keep all of these records in a clearly marked file in case you need them. There have been instances of a consumer suing a collection agency for violations of the law, but the judge didn’t take the consumer’s side because they couldn’t back up their claims with documentation.
Speaking of lawsuits, if you’re dealing with a debt collector who is refusing to obey the law, you may have a case against them for violations of the FDCPA.
