Sometimes the debt has already been paid, is someone else’s or has passed the statute of limitations, which means that they have no legal recourse to collect it.

The next thing you should do is keep careful records of all conversations that you have with a debt collector. Keep copies of all letters that you send, as well as any communications that you receive from them. Any time you send them written communication, send it certified mail, return receipt requested. If your state allows you to record phone calls, record the conversation every time you talk to a debt collector. Keep all of these records in a clearly marked file in case you need them. There have been instances of a consumer suing a collection agency for violations of the law, but the judge didn’t take the consumer’s side because they couldn’t back up their claims with documentation.

Speaking of lawsuits, if you’re dealing with a debt collector who is refusing to obey the law, you may have a case against them for violations of the FDCPA. Talk to an attorney who is familiar with the law and show them the documents that you’ve collected. If you take your case to court and win, the judge could award you up to $1,000 in damages, plus see to it that the collection agency pays court costs and attorney’s fees.
