P&B Capital Group was founded in 2004, and is headquartered in Buffalo, NY, with a second call center located in Tampa, FL. According to their website, P&B Capital Group takes a kinder, gentler approach to collections, and state that they believe successful collections occur when both debtor and creditor are satisfied with the results. They claim that Bank of America nominated P&B Capital Group for Small Business of the Year, and that they received a Certificate of Merit from the New York State Assembly for their contributions to the community. However, the local Better Business Bureau gives them a rating of F. As of September 2011, the BBB lists 71 complaints within the last three years. They have been sued in federal court 15 times in the past year for allegedly violating the Fair Debt Collection Practices Act.
Stop Debt Collector Harassment
The Federal Trade Commission says that 43% of the debt collection complaints they receive are about telephone harassment and multiple calls a day. If you think about it, a collector can't earn a commission unless he's talking to the consumer (or somebody he thinks he can convince to pay the bill), so why not keep calling until you make contact? Often, debt collectors count on consumers not knowing or understanding their rights, and can often get away with harassing behavior.
This kind of behavior has to be stopped. If you get calls from a debt collector, make sure to log every call, who you spoke to, and what was said. You have rights and you can sue (at no cost to you) to have those rights protected. In the process, you can collect up to $1,000.
