Howe & Associates is a debt collection agency located in Alpharetta, Georgia. It also appears to be an attorney’s office that specializes in personal injury cases. They operate two websites. The debt collection agency collects for businesses, banks, landlords, insurance companies, and private and commercial lenders. They also help businesses collect on judgments and sue those consumers who “won’t pay.”

The Better Business Bureau opened a file on the collection agency of Howe & Associates in August of 2007. They have yet to grant them accreditation, and have not given them a rating.

Stop Howe & Associates Harassment

Just because a debt collection agency has lawyers working for it, that doesn’t mean that they don’t have to follow the rules and guidelines set forth by the Fair Debt Collection Practices Act. Some debt collection agencies may become aggressive in their debt collection tactics. But luckily, there are laws that protect people—even if they do owe the debt.

  • The debt collector must prove that the debt is valid. A debt collector can’t just call a consumer and ask them to pay a debt. Instead, within five days of the original contact, the debt collector must send the consumer a letter telling them specifics about the debt in question. They must state who the original creditor was, the amount of the original loan, and disclose any fees that have been added to the debt.
  • If you receive such a letter and have doubts that the debt is yours, the FDCPA allows you to send a letter to the collection agency within 30 days asking them for more proof. During this time, they won’t be able to continue in their collection efforts, and must send you documentation showing that you owe the money.
  • If it’s proved that the debt is yours, you’ll be in control of the communication. If you only want to communicate with the debt collection agency in writing, then send them a cease and desist letter telling them so. It’s important that you send this letter via certified mail return receipt requested so you’ll have proof if they ignore your request. If you don’t want to communicate at all with them, you can tell them this in the letter. It won’t stop their collection attempts, but it will allow you some peace.

The Fair Debt Collection Practices Act also gives consumers who are being harassed by a debt collection agency the right to sue them in a court of law. An attorney who practices fair debt collection law can tell you whether or not you have a lawsuit. If you do and you win your case, a judge could grant you up to $1,000 in damages, plus order the collection agency to pay court costs and attorney’s fees.
