Global Debt Solutions began in Australia as Total Credit Management Services Pty Ltd, and now claims to have a network of more than 40,000 people in over 90 countries. They perform debt collection for corporations that export internationally. They work on a contingency basis, which means that they don’t earn any fees unless they collect the debt. Their website doesn’t hide the fact that they’re not afraid to use their “network” of attorneys if a consumer can’t pay up.
Global Debt Solutions has recently merged with Ansonia Credit Data, which is the largest global database of companies’ credit histories.
Stop Global Debt Solutions Harassment
If you owe money and can’t pay, you may have been contacted by a debt collector. But luckily for you, the Fair Debt Collection Practices Act outlines exactly how debt collectors are allowed to go about collecting that debt.
For starters, if you ask, they must prove to you that the debt is really yours. Many times debt collection agencies, in a hurry to try and get paid, will send out collection notices to someone who they “think” owes the debt, without really doing due diligence, in hopes that they’ll pay the debt without questioning it. But the FDCPA gives consumers the right to ask for validation of that debt. Once you receive the collection notice, you should send a debt validation letter to the collection agency within 30 days and ask for proof that the debt is yours. All collection efforts must cease until they can prove the debt is valid. Make sure to send the letter certified mail, return receipt requested, so the collection agency can’t claim that they never received it.
The law also prevents debt collectors from trying to embarrass or harass someone into paying a debt. They are only allowed to contact a third party to ask about your location, and aren’t allowed to call them again unless invited to. They can’t disclose the fact that they are a collection agency attempting to collect a debt. In certain states, debt collectors are allowed to contact the spouse of a consumer, and if you hire an attorney, the collection agency will only be allowed to talk to your lawyer.
Debt collectors must also be discreet when mailing you written correspondence. They aren’t allowed to send you communication via a postcard where your personal information will be in plain sight, and they can’t make it clear on an envelope that the letter is from a collection agency.
Make sure to keep a record of all written communications from debt collectors, and if it’s allowed in your state, record all phone calls. Then, if they violate the laws under the Fair Debt Collection Practices Act, you’ll have to proof you need to take them to court—and win.
