AmSher Collection Services is a debt collection agency headquartered in Birmingham, Alabama. AmSher collection agency specializes in the collection of healthcare debt, communications debt—such as old cell phone bills— and commercial debt, as well as old bank and retail debt. Their website has an ominous tagline: “We won’t lay a hand on anything but the telephone. Promise.” The first line of text on the AmSher collections site (as of June 2012) says, “Killer credentials.” Yikes!
AmSher collections agency touts itself as a family business, beginning in the late 1930s as a credit clothing store and some time after got into the credit furniture trade. AmSher became a collections agency in the mid-1980s. It’s hard to tell whether AmSher Collection Services is a debt collection agency that is playful or sinister. The photos used on the AmSher website – along with the captions – could be taken either way. For its healthcare collection page, AmSher Collection Service has a photo of a man sitting in a chair, covering his head with his hands, with his head in the corner of an empty room. The caption says, “We find money in the darndest places. Like your patients.”
AmSher Collection Agency Complaints
Internet discussion boards are rife with AmSher collection agency complaints. AmSher received its accreditation from the Better Business Bureau in 1986, and as of June 2012, has an A+ rating with the BBB. This is surprising in light of the fact that the BBB notes 111 closed AmSher collection agency complaints in the past three years, including 32 closed AmSher collection agency complaints in the past 12 months. But there are also AmSher collection agency complaints filed in federal court. In fact, there were eight complaints filed against AmSher in the first half of 2012 for alleged violations of the Fair Debt Collection Practices Act.
Stop AmSher Collection Services Harassment
The Fair Debt Collection Practices Act was put into place to stop debt collection agencies – whether AmSher Collections or any other – from harassing consumers when trying to collect a debt. For example, whenever an AmSher Collections debt collector calls you, he or she must identify him or herself, and not lie about whom they are. In addition, AmSher collection agency must provide you, in writing, a detailed report about the original creditor and the amount of the original debt, and then disclose any fees or charges that they’ve added to the balance.
When AmSher collections agency calls you, they must do so between the hours of 8 a.m. and 9 p.m. in your time zone. AmSher can’t call you so many times that it constitutes harassment, and AmSher can’t leave a message that others will hear about you owing a debt. AmSher Collection Service isn’t allowed to talk to anyone else about your debt, except some state laws allow them to talk to your spouse.
The good news is that if a debt collection agency has violated your rights under the Fair Debt Collection Practices Act, you don’t have to take it. You can file a lawsuit against the company in a court of law, and if the judge decides in your favor, you could be awarded up to $1,000 in damages, plus your attorney fees and court costs.
