AP Financial Services is a debt collection agency that has offices in Phoenix, Arizona, and services the medical, commercial, and utilities industries. Before it was AP Financial Services, it was called SOS Collection Services, which was formed when National Collex and the Arizona Creditors Bureau were merged. The Better Business Bureau still lists the companies as operational and lists the various names as alternative business names. While the AP Financial Services website is operating and fully functional, as of April 2012 the Arizona Department of Financial Institutions says that the debt collection agency is currently in the process of renewing its license. If a debt collection agency attempted to collect debts without a current and approved license, they would be in violation of the law.

The Fair Debt Collection Practices Act was signed into law in 1977 in order to make the debt collection arena a safer place for consumers. In the past, debt collectors were allowed to lie to and threaten consumers in their attempts to force them to pay their debts. As a result, many consumers ended up paying debts that they didn’t owe, or paid debts they couldn’t afford because debt collectors threatened to throw them in jail or garnish their wages when they didn’t have the authority to do so.
But the FDCPA changed the way that debt collectors are allowed to collect debts. For starters, consumers no longer need to feel obligated to pay a debt until they are certain that it’s truly theirs. Because of the FDCPA, debt collection agencies must now send you a letter within five days of first contacting you, and giving you certain details about the debt they’re trying to collect. The letter must give you the name of the original creditor and the amount of the original loan, as well as disclose any fees that have been added to the balance. If after receiving this letter you aren’t sure whether or not the debt is yours, you have a right to send a debt validation letter asking for more proof. Be sure to send this letter within 30 days of receiving the first letter from the collection agency, or the agency will have the legal right to assume that the debt is valid.
In addition, debt collectors can no longer make threats that are illegal or that they don’t intend to carry through. For instance, if a debt has already passed its statute of limitations, a debt collection agency can no longer take you to court. The Fair Debt Collection Practices Act prohibits debt collectors from threatening consumers with these actions, and if they do, they’re in violation of the law.

If you take the case to court and win, you could be awarded up to $1,000 in damages, plus be awarded court costs and attorney fees.
