National Action Financial Services
National Action Financial Services, also known as NAFS, is a debt collection agency that has offices in Williamsville, New York. National Action Financial Service has been in business since 1994, and is a first and third party debt collector. National Action Financial Services debt collection agency uses both live agents and robocalls to contact consumers, and is licensed in all 50 states.
National Action Financial Services Complaints
The Better Business Bureau seems to contradict itself regarding National Action Financial Services complaints. On one hand, it gives NAFS an A+ rating, the highest that it can, while on the other hand, it reports that, as of June 2012, it’s closed 211 NAFS complaints within the past three years, including 26 closed NAFS complaints within the past 12 months. Plus there have been eight National Action Financial Services lawsuits filed in the first half of 2012. In addition, in 2007 New York’s then-Attorney General Andrew Cuomo announced that National Action Financial Services had agreed to pay $85,000 in penalties for allegedly using abusive, false, and misleading tactics, and that NAFS had agreed to reform its business practices.
Stop National Action Financial Services Harassment
The Fair Debt Collection Practices Act was put into place to stop harassment by debt collection companies – whether National Action Financial Services or any other debt collection agency. For starters, the law is very specific about when a debt collector can call you. They can only do so between the hours of 8AM and 9PM in your time zone. An NAFS debt collector – or any other debt collector – can’t call you at work if you’re not allowed to receive phone calls there, and they aren’t allowed to use the phone as a form of harassment so you’ll pay your debt. If you want National Action Financial Service to stop calling you altogether (or writing), send them a cease and desist letter by certified mail, return receipt requested. By law, NAFS won’t be allowed to contact you anymore.
In addition, you have rights if a debt collector contacts you about a debt that isn’t even yours. Within 30 days of their first contact, you can dispute the debt, and ask them to provide you with proof that the debt is yours. A debt collection agency – whether National Action Financial Services or any other agency – isn’t allowed to simply show you a computer printout with your name on it. Instead, they have to provide you with some documentation that shows you agreed to pay the debt. The burden of proof is on them, not you.
