If you dispute the debt, the debt collector must provide you with validation of the debt, and cease communications until they are able to do so. The FDCPA also specifies that a debt collector may not contact a consumer repeatedly or continuously with intention of annoying, abusing or harassing him or her.
Under the FDCPA, it is unlawful for a debt collector to make threatening comments. Debt collectors may not use obscene language, insult or belittle you in an attempt to coerce you into paying a debt.
If you are being harassed by a debt collector, you have the right to hire an attorney and file suit against them for violating the FDCPA. If found guilty, they may have to pay up to $1,000 in damages, plus attorney’s fees and court costs.
